China's legal system is characterized by the gap between law and reality. Focusing on regulatory law, and with reference to the foreign investment area, this book identifies the functional and structural problems within China's administrative legal system that perpetuate this gap. Topics examined in depth include China's unusual hierarchy of legislation, the lack of clear delineation between legal and policy norms, the great scope of discretion accorded to bodies charged with legal interpretation and implementation, the limited scope of judicial review, and the resulting problems of legislative inconsistency and haphazard legal enforcement. The book contends that China's legal system is being built on a faulty and incomplete basis, and that if these problems remain unaddressed, China's legal future is at risk.

What lessons can be learnt from the accession to the World Trade Organization (WTO) of Russia, China, and Ukraine? Were there any peculiarities in the adaptation of their economies to the rules and norms of the organisation, and what impact did it have on the world trade system? This detailed, systematic, and comparative analysis of the social and economic impact of the accession of these countries to the WTO addresses these questions, presenting an economic and legal analysis of the reasons and consequences of their joining the WTO. Comparative legal and economic methods are used to explore the social and economic causes and consequences of membership for post-communist states and to suggest ways in which new members can adapt to WTO standards. This work will be of interest to experts and students in the fields of economics, jurisprudence, and customs affairs.

Trade Agreements at the Crossroads

Trade Agreements at the Crossroads Author Susy Frankel

The book examines trade agreements in the context of the current world economic crisis and the uncompleted World Trade Organization (WTO) Doha Round of trade negotiations. With economies shrinking and protectionism on the rise, many fear a protracted global recession. This raises important questions as to what role trade agreements – multilateral, plurilateral, and bilateral – should be playing in the current climate of uncertainty, and how best to plan for a more stable economic future. Previous assumptions are now being questioned, making this an opportune time to critically examine the WTO, free trade agreements, bilateral investment treaties, and other international economic law instruments. Furthermore, participants in international agreements are concerned with emerging issues that have the potential to strengthen or weaken the global trading system, including matters of treaty interpretation; terms of new agreements; and effects of existing provisions. This book provides a timely addition to the international economic law literature, as its submissions have been prepared during a time of unusual uncertainty and economic change; individuals interested in international economic law will seek scholarship that recognizes the current international economic climate. This book should be of interest to a wide range of academics and student researchers, as well as policymakers and practitioners.

EC Trade Law Following China s Accession to the WTO

EC Trade Law Following China s Accession to the WTO Author Jan Hoogmartens

The World Trade Organisation cannot be deemed truly international without the full participation of China, a massive market with an increasing number of highly sophisticated sectors. Yet'although China did accede to the WTO in 2001, after fifteen years of negotiations'WTO members persist in classifying China as a non-market economy, with all the trade restrictions such labelling entails. The EC in particular continues to curtail the flow of Chinese-European trade, despite some recent liberalisation in EC import and antidumping regulations. In this important book Dr. Hoogmartens clearly points the way to an equitable resolution of the complex problems raised by the friction between China's planned economy and EC trade policy instruments. The 'economic interface' he constructs takes account of such crucial elements as the following: China's 'unfinished' legal and economic reforms; the danger that the EC may develop an abusive protectionist stance; the challenge to the EC of increased Chinese competition; the persistence of Chinese state-owned enterprises; the absence of a satisfactory methodology to deal with the Chinese variant of a non-market economy; the possible adjustment of EC antidumping regulations vis-à-vis China; emergency safeguards; the role of the rule of law in trade regulation; and the 'translatability' of Western social and political institutions. Addressing as it does a highly salient present and future aspect of the global economy, EC Trade Law Following China's WTO Accession will be of enormous value to policymakers in international economic law at all national and supranational levels. The author's reasoned and cautious analysis builds a sound platform for the ongoing development of peaceful and mutually beneficial commercial relations between Europe and China.

Special Economic Zones in Asian Market Economies

Special Economic Zones in Asian Market Economies Author Connie Carter

Special Economic Zones (SEZs) have proliferated rapidly during the past decade and are set to multiply in the next – embracing not only Asia and Europe but also Africa and the Americas. This book is the first to examine the Asian experience of SEZs in China, India, Malaysia and the Philippines. SEZs are usually clearly defined geographic areas in which national, provincial or local governments use policy tools (such as tax holidays; improved infrastructure; less onerous or differentiated regulations and incentives other than those generally available in the rest of the country) to attract and promote private - usually foreign - investment from enterprises which commit to create employment and to export their products or services, and generating foreign currency for the host country. SEZs have been especially successful in bringing about economic development in Asia, especially in China. This book examines the origins, nature and status of special economic zones in Asia, together with the current trends connected with them, and the challenges they currently face. Although the World Trade Organisation cast doubts in 1995 on the future of special economic zones as a viable policy tool in the development agenda, special economic zones continue to be used, and favoured, as a way of encouraging foreign investment and economic development, with for example India, trying to emulate China, reincorporating special economic zones into its development policy. This book provides regional case studies of SEZs in Asian market economies to analyse the extent to which these zones serve the changing needs of Asian development.
